Promoter

1. The promoter is Saputo Dairy Australia Pty Ltd, ABN 52 166 135 486, Level 14, 28 Freshwater Place, Southbank VIC, 3006 (Promoter).

Entry restrictions

2. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

3. Entry is open to Australian residents aged 18 years or over located in Australia. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.

Promotion periods

4. The Promotion comprises two sets of periods:

(a) You must purchase the Carton of Caboolture Mozzarella Shredded Cheese product (2 x 6kg carton) between 9.00am (AEST) on 8^th April 2024 and 5.00pm (AEST) on 30^th June 2024 (Promotion Period).

(b) Your prize claim must be received by the Promoter between 8.00am (AEST) on 8^th April 2024 and 5.00pm AEST on 7^th July 2024 (Claim Period).

Eligibility

5. To be eligible to enter the Promotion and receive a prize, an entrant must:

(a) During the Promotion Period:

(i) purchase a Carton of Caboolture Mozzarella Shredded Cheese product (2 x 6kg carton) through an SDA authorised distributor; and

(ii) find a Golden Ticket hidden in the carton.

(b) During the Claim Period:

(i) take a photo of the Golden Ticket and email the photo to aus.foodservice@saputo.com

(ii) reply and complete the further instructions provided by the Promotor in relation to claiming the prize; and

(iii) present the original Golden Ticket and proof of purchase to the Promoter for validation by the date notified by the Promoter. A Golden Ticket and proof of purchase will be invalidated and the entrant ineligible if, in the Promotor’s opinion, the ticket or proof of purchase is forged, mutilated or tampered with in any way or otherwise rendered illegible or if it fails the Promoter’s verification tests. An entry is void if the Golden Ticket or proof of purchase is not presented for any reason, including if it is lost or stolen.

Prizes

6. There are 22 Golden Tickets to be given away as prizes in this Promotion: 2 x AUD5,000.00, 5 x AUD2,000.00 and 15 x AUD1,000.00. The total prize pool is AUD35,000.00.

7. Prizes will be awarded by the Promoter within 14 days of the Promoter receiving and validating the Golden Ticket.

8. Prizes will be awarded in the form of a bank transfer into an Australian Bank Account nominated by the entrant.

9. Prizes will be awarded to the authorised account holder(s) of the nominated bank account, and accordingly, if the entrant is not the authorised account holder of the nominated bank account, the entrant agrees to assign all rights in the prize to the authorised account holder and releases the Promotor from any claim in respect of the assigned prize.

10. Promotional Cartons that contain a Golden Ticket will be distributed at random in Australia.

11. If a prize is not claimed by an entrant during the Claim Period, or the Promoter has been unable (despite reasonable efforts) to successfully contact the entrant, or an entrant is determined by the Promoter to be ineligible to win a prize in accordance with these conditions, or a Golden Ticket has been invalidated by the Promotor, the relevant prize(s) will be forfeited.

12. The prize must be taken as offered and is non-redeemable for cash or other goods or services.

13. All winners, will have their name, postcode (or town) announced on the Promoter’s website www.saputofoodservice.com.au by 14^th July 2024.

General Terms

14. The Promoter reserves the right, at any time, to verify the validity of an entry and the eligibility of an entrant (including their identity, age, place of residence and proof of purchase), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion (acting reasonably), to determine the identity and eligibility of the entrant. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

15. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

16. The Promoter's decision in relation to any aspect of this Promotion, including the eligibility of an entrant and the determination of any winner, is final and binding on every person who enters. No correspondence will be entered into.

17. Should an entrant's contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

18. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize. The Prize value in these Terms and Conditions are in Australian dollars and include Australian GST where applicable.

19. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate, subject to (if applicable) the approval of the authorities that have issued permits for its conduct.

20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia (Non Excludable Guarantees).

21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Privacy and use of entrant’s information

22. Entrants consent to the Promoter using their name, likeness, image and/or voice, along with the winning posted image, in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. All entries become the property of the Promoter.

23. The Promoter is collecting the entrant's personal information for the purpose of conducting this promotion (including but not limited to determining and notifying winners). The entrant's personal information may be disclosed to representatives and agents acting on behalf of the Promoter or assisting the Promoter in the administration of this promotion, including prize suppliers and deliverers.
