Terms and Conditions

Background

  • The promoter is Saputo Dairy Australia Pty Ltd, ABN 52 166 135 486, Level 14, 28 Freshwater Place, Southbank VIC 3006 (Promoter).
  • This document contains the terms and conditions of the CHEER promotion run by the Promoter (Promotion).
  • Entry into the Promotion is only open to the foodservice distributors selected and invited to participate by the Promoter (Distributors).

Eligibility

  • The Promotion applies to the following products:
  • 1013093: CHEER™ Thick & Tasty Shred 6x2kg
  • 1013097: CHEER™ Parma Blend Natural Shred 6x2kg
  • 1013049: CHEER™ Aussie Jack Natural Shred 6x2kg
  • 1013098: CHEER™ Tasty Catering 96 Slices 8x1.5kg
  • 1013091: CHEER™ Tasty 72 Slices 8x1.5kg
  • 1013050: CHEER™ Aussie Jack 96 Slices 8x1.5kg

(Participating Products).

  • For a Distributor’s purchase of a Participating Product from the Promoter to be eligible to be counted for the Promotion:
    • the order must be received by the Promoter between the period from 9.00am (AEST) on 1 July 2026 until 10.00am (AEST) on 28 August 2026 (Promotion Period); and
    • the Distributor must receive a valid invoice from the Promoter by 31 August 2026.
  • The following will not be eligible to be counted in the Promotion:
    • any Participating Products which are returned by the Distributor to the Promoter at any time; or
    • any Participating Products provided free of charge (e.g. sample stock).

Designated Territories and Categories

  • For the purposes of the Promotion, Distributors are split between the following four designated territories:
    • Victoria and Tasmania;
    • New South Wales and Australian Capital Territory;
    • Queensland; and
    • South Australia, Western Australia and Northern Territory,

(each a Designated Territory).

  • SDA will allocate each Distributor to a Designated Territory based on how its account is managed by the Promoter. If a Distributor has multiple offices, it is only able to compete in one Designated Territory and all of its purchases will be combined and treated as one total.
  • In each Designated Territory, the Promoter will group Distributors into two categories based on their Historical Purchase Volume (defined in clause 13):
    • Category A – Distributors with a Historical Purchase Volume of at least 200 cartons; and
    • Category B – Distributors with a Historical Purchase Volume of less than 200 cartons,

(each, a Category).

  • There will be a Category A and Category B winner in each Designated Territory, meaning there will be eight separate competitions (each, a Competition).
  • A Distributor will be ineligible for the Promotion if it does not meet the following minimum purchase conditions across the Promotion Period for its applicable Category:
    • Category A: The Distributor must purchase a minimum of one pallet (in aggregate) per Participating Product for at least three different Participating Products SKUs, which must include at least one ‘shred’ SKU and one ‘slice’ SKU.
    • Category B: The Distributor must purchase a minimum of a ½ pallet (in aggregate) per Participating Product for at least two different Participating Products SKUs, which must include at least one ‘shred’ SKU and one ‘slice’ SKU.
  • Each pallet of Participating Product contains either 63 cartons (for slice SKUs) or 40 cartons (for shred SKUs). Each carton contains 12kg of product.

Determination of winners

The winner of each Competition will be the Distributor with the highest percentage uplift of purchases, calculated as follows:

Uplift (%) = ((Current Volume – Historical Purchase Volume) ÷ Historical Purchase Volume) × 100

Where:

Current Volume = Number of cartons of Participating Products purchased by the Distributor during the Promotion Period.

Historical Purchase Volume = Number of cartons of Participating Products purchased by the Distributor as a two-month average taken over the period of 1 April 2025 to 31 March 2026.

  • For the purposes of the calculation in clause 13, if a Distributor has not purchased a sufficient volume of Participating Products to generate an appropriate Historical Purchase Volume, the Promoter will allocate a different Historical Purchase Volume to that Distributor (based on the average Historical Purchase Volume of the Distributors within Category B). The application of this clause will be determined by the Promoter in its absolute discretion.

Prizes

  • The applicable prize for the winner of each Competition will be one of the following (based on their Designated Territory):
    • AFL Grand Final Package: Victoria and Tasmania; South Australia, Western Australia and Northern Territory.
    • NRL Grand Final Package: New South Wales and Australian Capital Territory; Queensland.

AFL Grand Final Package:

  • The winning Distributor in each Competition will receive one ticket and will be accompanied by a representative of the Promoter.
  • 2 nights’ accommodation at The Langham Melbourne (Friday 25 September – Sunday 27 September 2026). Double room. Breakfast included.
  • One ticket to the pre-game AFL Grand Final Breakfast (Saturday 26 September 2026) hosted by North Melbourne Football Club, located at the Melbourne Convention Centre.
  • One Level 1 reserved seat grandstand ticket to the AFL Grand Final (Saturday 26 September 2026).
  • One set of return flights included if Distributor is based in Tasmania, South Australia, Western Australia or Northern Territory.

NRL Grand Final Package:

  • The winning Distributor in each Competition will receive one ticket and will be accompanied by a representative of the Promoter.
  • 2 nights’ accommodation at the Meriton Suites Sussex Street, Sydney (Saturday 3 October – Monday 5 October 2026). One bedroom suite.
  • One Premium Diamond reserved grandstand seat to the NRL Grand Final (Sunday 4 October 2026) and full access to the Captains Club Hospitality Package.
  • One set of return flights included if Distributor is based in Queensland or Australian Capital Territory.
  • The eight successful Distributors will be contacted by the Promoter within 14 days after the Promotion Period.
  • All prizes will be distributed by the Promoter within 7 days of receiving all required information from each winning Distributor. All prizes must be taken as offered and are not redeemable in any other form.

General Terms

  • The Promoter's decision in relation to any aspect of the Promotion, including the eligibility of a Distributor (or a Distributor’s purchase) and the determination of winners, is final and binding. No correspondence will be entered into.
  • All calculations will be based on the Promoter’s internal data. The Promoter may exercise reasonable discretion in respect of the timing or eligibility of a purchase of a Participating Product.
  • The Promoter will not:
    • buy back from the Distributor; or
    • provide any support for the clearance of,
  • any Participating Products purchased by the Distributor during the Promotion Period.
  • The Promoter will determine the Designated Territory in which each Distributor is allocated in its absolute discretion.
  • If the Promoter is unable (despite reasonable efforts) to successfully contact a winning Distributor, or the Distributor fails to provide any required information within a reasonable time of the Promoter’s written request to do so, then the Promoter reserves the right to determine the Distributor to be ineligible for the prize.
  • The Promoter may, in its absolute discretion (acting reasonably), disqualify a Distributor and prohibit further participation in the Promotion by, any person who acts in violation of these terms and conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
  • If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right to modify, suspend, terminate or cancel the Promotion as appropriate in its absolute discretion (acting reasonably) and to the fullest extent permitted by law.
  • The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
  • Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  • Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
  • Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any indirect, special or consequential loss (including loss of opportunity) arising out of the Promotion.
  • Except if required to be accepted under the Non-Excludable Guarantees, the Promoter will not accept the return of any Participating Product after the end of the Promotion Period.
  • The Promotion is run in the States of Victoria (VIC), New South Wales (NSW), Tasmania (TAS), Queensland (QLD), Western Australia (WA), and the Australian Capital Territory (ACT) and Northern Territory (NT).
  • The Promoter will determine any tie-breaks in its absolute discretion.
  • The Promoter accepts no responsibility for any tax liabilities that may arise from receiving the benefit of a prize. Any prize value in these Terms and Conditions is in Australian dollars and include Australian GST where applicable.

Privacy and use of information

Distributors consent to the Promoter announcing their name in the event they are a winner.

The Promoter may collect the personal information of a Distributor’s employees for the purpose of conducting the Promotion (including but not limited to notifying winners and allocating prizes). Such personal information may be disclosed to representatives and agents acting on behalf of the Promoter or assisting the Promoter in the administration of the Promotion, including issuing the prizes.
