Terms and Conditions
Promoter
- The promoter is Saputo Dairy Australia Pty Ltd, ABN 52 166 135 486, Level 14, 28 Freshwater Place, Southbank VIC 3006 (Promoter).
- These Terms and Conditions govern two separate promotions.
• Details of the first promotion are set out in clause 10 (Promotion 1).
• Details of the second promotion are set out in clause 11 (Promotion 2).
(Together, the Promotions).
Entry
- Entry into the Promotions is open to the foodservice distributors chosen by the Promoter (Distributors) and the Distributor’s sales agents/representatives (Sales Agents), (together, the Entrants).
- Entry into the Promotions is deemed acceptance of these Terms and Conditions.
Promotion periods
- To enter into the Promotions, Sales Agents must be:
a. a natural person;.
b. aged 18 years or over; and.
c. an Australian resident located in Australia..
- Each Promotion runs for a separate applicable Promotion Period:
• Promotion 1 commences at 9.00am (AEST) on 1 July 2025 and ends at 5.00pm (AEST) on 31 July 2025 (Promotion Period 1).
• Promotion 2 commences at 9.00am (AEST) on 1 July 2025 and ends at 5.00pm (AEST) on 31 August 2025 (Promotion Period 2).
- Claims for an incentive reward must be received by the Promoter before the following applicable Claim Date:
• Promotion 1: 5.00pm (AEST) on 28 August 2025 (Claim Date 1).
• Promotion 2: 5.00pm (AEST) on 28 September 2025 (Claim Date 2).
Promotions and incentive rewards
- The Promotions relate to the sale of Fred Walker Individually Quick Frozen Mozzarella 2x5kg (item code 1018099) (Product).
- The minimum order quantity of the Product applicable to the Promotions is 10 cartons per order (MOQ). Each carton contains two 5kg units of Product.
Promotion 1
- The following terms are applicable to Promotion 1.
a. The incentive reward for Promotion 1 is a $150 Mastercard e-Gift card.
b. The incentive reward is available for the first order of the Product (which meets the MOQ) by a customer which has not purchased any product offered by the Promoter in the current calendar year (2025) (Eligible Purchase).
c. A customer’s purchase history of the Promoter’s products will be reviewed and determined by the Promoter. For the avoidance of doubt, only the first order of the Product made by such a customer will apply, not any subsequent orders by that customer. If an Eligible Purchase is cancelled for any reason, it will become ineligible.
d. The requirements for making a claim for an incentive reward are set out in clauses 12 to 19 below.
e. Sales Agents can be awarded multiple incentive rewards (i.e. one for each Eligible Purchase).
f. The relevant order for an Eligible Purchase must be placed before the end of Promotion Period 1. The timing of orders cannot be amended.
g. There are 100 incentive rewards to be won. Incentive rewards will only be awarded while stocks last. The Promoter reserves the right to conclude Promotion 1 before the end of Promotion Period 1 if the number of available incentive rewards is exhausted.
h. Incentive rewards will be sent to the applicable Sales Agent’s email address nominated in writing by the Distributor.
i. The Promoter takes no responsibility for any terms and conditions of use of the incentive reward e-Gift card, as set by the issuer.
Promotion 2
- The following terms are applicable to Promotion 2.
a. The Promotion 2 incentive rewards are:
i. $3,500, for the Sales Agent which is attributed the highest number of Eligible Purchases during Promotion Period 2; and
ii. $750, for the Sales Agents which are attributed to the second and third highest number of Eligible Purchases during Promotion Period 2.
b. The determination of an Eligible Purchase is subject to the same terms set out in clauses 10b and 10c above.
c. The requirements for making a claim for the incentive rewards are set out in clause 12 to 19 below.
d. A Sales Agent’s individual tally of Eligible Purchases will be counted by the Promoter. Entries will only be included if they comply with these Terms and Conditions, as determined by the Promoter.
e. In the event of a tie, the applicable incentive reward will be split equally between those Sales Agents.
f. The relevant order for an Eligible Purchase must be placed before the end of Promotion Period 2. The timing of orders cannot be amended.
g. The incentive rewards for Promotion 2 will be awarded in the form of a bank transfer into an Australian bank account nominated by the Sales Agent. If the Sales Agent is not the authorised account holder of the nominated bank account, the Sales Agent agrees to assign all rights in the incentive reward to the authorised account holder and releases the Promoter from any claim in respect of the assigned incentive reward.
How to Claim
- To make a claim for the incentive rewards, the Distributor is to collate a list of all orders of the Product it has received during the Promotion Period to date, and send this by email to the Promoter at aus.foodservice@saputo.com. The Distributor is to send an updated list on the Friday of each week during the applicable Promotion Period. All claims for the incentive rewards must be sent to the Promoter by the applicable Claim Date.
- Each order in the list provided by the Distributor must include the full name of the Sales Agent that is the Distributor’s allocated representative/relationship manager (or equivalent) of the customer which made that order. There may only be one Sales Agent attributed to any Eligible Purchase.
- If a Sales Agent does not wish to enter into the Promotions, the Distributor must exclude any orders attributable to this Sales Agent from the list it provides to the Promoter.
- When making the claim, Distributors must also provide the phone number and email address of each applicable Sales Agent. By providing the information of the Sales Agent to the Promoter, the Distributor warrants that:
a. the Sales Agent has authorised the Distributor to provide that information to the Promoter; and
b. the Sales Agent has consented to enter into the Promotion under these Terms and Conditions (including being contacted by the Promoter).
- The Entrant must provide any additional information that the Promoter reasonably requires to satisfy the applicable Promotion requirements.
- Successful Sales Agents will be contacted by the Promoter within 14 days of the applicable Claim Date (subject to clause 16 above). For Promotion 2, the Sales Agent must provide the Promoter with the BSB, Account Number, and Account holder name for their nominated Australian bank account.
- All incentive rewards will be awarded by the Promoter within 28 days of receiving all required information from each Entrant. All incentive rewards must be taken as offered and are not redeemable in any other form.
- If:
a. an Eligible Purchase is not claimed by the applicable Claim Date; or
b. the Promoter is unable (despite reasonable efforts) to successfully contact an Entrant; or
c. a Sales Agent fails to provide any required information within a reasonable time of the Promoter’s written request to do so,
then the Promoter reserves the right to determine the relevant Entrant to be ineligible for an incentive reward.
General Terms
- The Promoter's decision in relation to any aspect of the Promotions, including the eligibility of an Entrant and the determination of any incentive rewards, is final and binding on every person who enters. No correspondence will be entered into.
- The Promoter reserves the right, at any time, to verify the validity of an entry and the eligibility of an Entrant (including their identity, age, place of residence and proof of purchase), and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion (acting reasonably), to determine the identity and eligibility of the Entrant.
- An entry will be invalidated and the Entrant will be ineligible if, in the Promoter’s opinion, the entry evidence is forged or tampered with in any way or otherwise fails the Promoter’s verification procedures. The Promoter may, in its sole discretion (acting reasonably), disqualify an Entrant and prohibit further participation in these Promotions by, any person who acts in violation of these Terms and Conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
- Should an Entrant's contact details change during the applicable Promotion Period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
- The Promoter accepts no responsibility for any tax liabilities that may arise from receiving the benefit of an incentive reward. The incentive reward value in these Terms and Conditions are in Australian dollars and include Australian GST where applicable.
- If these Promotions are interfered with in any way or are not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right to modify, suspend, terminate or cancel the Promotions as appropriate in its sole discretion (acting reasonably) and to the fullest extent permitted by law.
- The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
- Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any indirect, special or consequential loss (including loss of opportunity) arising out of the Promotions.
- The Promotions are run in the States of Victoria (VIC), New South Wales (NSW), Tasmania (TAS), Queensland (QLD), Western Australia (WA), and the Australian Capital Territory (ACT) and Northern Territory (NT).
Privacy and use of Entrant’s information
- Entrants consent to the Promoter using their name in the event they are a winner.
- The Promoter is collecting the Entrant's personal information for the purpose of conducting the Promotions (including but not limited to determining and notifying winners). The Entrant's personal information may be disclosed to representatives and agents acting on behalf of the Promoter or assisting the Promoter in the administration of the Promotions, including issuing the incentive rewards.
- A request to access, update or correct any information should be directed to the Promoter. The Promoter’s privacy policies (being the Privacy Statement and Privacy Collection Statement) are available on the Promoter’s website at https://www.saputodairyaustralia.com.au/en/our-policies.
